Terms of Service – Tales & Treasures

These Terms of Service (“Terms”) govern your access to and use of the Tales & Treasures website and services (the “Services”). By accessing the Services, placing an order, submitting content, or receiving deliverables, you agree to these Terms.

If you do not agree, do not use the Services.

2) Eligibility

You must be at least 18 years old to place an order. By using the Services, you represent that you meet this requirement.

3) The Services

We create custom, faith-aligned, family-story-based creative works, which may include:

  • A written story (typically 2,000–2,500 words, unless otherwise stated)

  • Optional illustrations (which may be AI-assisted)

  • Optional printed products and shipping (if offered)

All deliverables are creative works. Story tone, style, and content are subjective.

4) Intake Submissions; Sensitive Information Prohibited

You agree not to submit highly sensitive information, including but not limited to passwords, financial account numbers, payment card details, government IDs, or detailed medical records.

You also agree not to submit a child’s direct contact information (phone/email) or school information.

5) AI-Assisted Services (Disclosure)

You acknowledge and agree that we may use third-party AI tools (such as Claude by Anthropic and/or ChatGPT by OpenAI) and other software tools to help generate drafts, refine text, and format content. We may also use AI-assisted illustration tools to generate images based on prompts derived from your story.

AI output may be inaccurate, incomplete, unexpected, or objectionable. You agree we do not guarantee any specific outcome, interpretation, or satisfaction.

6) Content Guidelines (Faith-Aligned)

We create stories consistent with Christian values based on the biblical truths and facts of the Bible.

We do not create content that is pornographic/sexually explicit, promotes hatred or harassment, or is intended to shock, degrade, or exploit. We may decline requests that seek prohibited content.

7) Your Representations and Permissions

By submitting intake materials, you represent and warrant that:

  • You have the right and permission to provide the materials to us, including information about family members or others referenced in your story; and

  • Your submission does not violate laws or infringe the rights of others (including privacy, publicity, or intellectual property rights)

You are responsible for the accuracy of the information you submit.

8) Intellectual Property; Ownership of Deliverables

A) Your Pre-Existing Materials

You retain ownership of your pre-existing materials. You grant us a limited, non-exclusive license to use your materials solely to create, deliver, and support your order and to operate our business.

B) Your Custom Deliverable

Upon full payment, we assign to you our rights (if any) in the final story deliverable to the extent permitted by applicable law. We do not guarantee that any deliverable qualifies for copyright protection in all jurisdictions.

C) Our Materials

We retain all rights in our trademarks, branding, website content, templates, and non-customer-specific materials.

9) Revisions and Corrections

Unless otherwise stated at checkout:

  • One (1) round of minor revisions is included

  • Factual errors (wrong names/dates/details that conflict with your questionnaire) will be corrected at no charge

  • Additional revision rounds are available for $50 per round for changes beyond factual corrections

You must request revisions within [30] days of delivery unless otherwise stated.

10) Refund Policy

Because each order is custom-created and cannot be resold:

  • No refunds after the story is delivered, except where required by law.

  • If you request changes due to factual inconsistencies with your intake form, we will work with you under the revision policy above.

If you want a stricter policy (and stronger protection), you may also state: “No refunds after work begins.” If you adopt that, make sure your checkout page clearly explains when “work begins.”

11) Printing, Fulfillment, and Shipping (If Purchased)

If you purchase printed products:

  • We will share only the information necessary (e.g., recipient name, shipping address, and order details) with printing/fulfillment providers and shipping carriers.

  • Delivery timelines are estimates and may be affected by carrier delays, customs, or events outside our control.

  • We are not responsible for delays caused by carriers or incorrect addresses provided by you.

12) Marketing Use (Opt-In Only)

We will not use your story, excerpts, testimonials, or images for marketing unless you explicitly consent (for example, by checking an opt-in box). If you consent, we will aim to remove names and identifying details.

13) Disclaimers

THE SERVICES AND DELIVERABLES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not provide legal, medical, therapeutic, counseling, or other professional advice.

14) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

  • OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO AN ORDER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT ORDER.

Some states do not allow certain limitations, so these limits apply to the extent permitted by law.

15) Indemnification

You agree to indemnify and hold harmless Tales & Treasures from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from:

  • Your submitted materials

  • Your breach of these Terms

  • Your violation of any law or third-party rights

16) Dispute Resolution; Governing Law

Governing law: These Terms are governed by the laws of the State of [Montana], without regard to conflict-of-laws principles.

OPTIONAL BUT RECOMMENDED (Arbitration + Class Action Waiver)

If you want arbitration, paste this section and have a lawyer tailor for your state and consumer enforceability:

Binding Arbitration. Any dispute arising from these Terms or the Services will be resolved by binding arbitration on an individual basis, rather than in court, except that either party may bring claims in small claims court if eligible.
Class Action Waiver. You and Tales and Treasures agree that disputes will be brought only in an individual capacity and not as a class, consolidated, or representative action.

(If you don’t want arbitration yet, remove this subsection and instead use venue/jurisdiction language.)

17) Changes to the Services or Terms

We may update the Services and these Terms from time to time. The “Last Updated” date indicates when changes were made. Continued use after changes constitutes acceptance.

18) Miscellaneous

  • Assignment: You may not assign these Terms without our consent; we may assign them in connection with a business transfer.

  • Severability: If any provision is unenforceable, the rest remains in effect.

  • Entire Agreement: These Terms and any posted policies (including the Privacy Policy) are the entire agreement regarding the Services.

  • Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control.
